A condition is an action that the home has to take to be in good standing. Review this to see if they raise any questions for you as you consider the home.
Condition 1: The Licensee must employ or retain, at its own expense, a person, acceptable to the RHRA with experience managing the operations of a congregate care facility, who will have full responsibility for directing and supervising the operations of the Home, including:i. Monitoring and ensuring compliance with the Retirement Homes Act, 2010 (“the Act”) and O.Reg. 166/11 (“the Regulation”), and compliance with the Ontario Fire Code;
ii. Ensuring residents receive appropriate care and live in a safe and secure environment with dignity and respect;
iii. Ensuring that staffing levels are appropriate to ensure resident care and safety needs are met at all times;
iv. Ensuring that residents whose behaviour poses risks to themselves, or others, are identified, and that appropriate behaviour management strategies and techniques are implemented for them, including protecting residents from risks caused by wandering and other emergency incidents, at all times, and particularly at night;
v. Reporting to the RHRA monthly, or as otherwise requested by the RHRA, on the status of the Home, the implementation of the Conditions, and any concerns regarding compliance with the Act.
Condition 2: The Licensee must provide the person referred to in Condition 1 with the authority, as well as sufficient financial and other resources, to perform the tasks set out in Condition 1.
Condition 3: The Licensee must ensure that the person referred to in Condition 1 is physically present in the Home for a minimum of 7.5 hours per week, and may be required to spend further hours working remotely from the Home.
A person with a controlling interest owns more than 50% of the licensee's voting shares.
